AUBURN, IN - The man being held responsible for hitting and killing an Indiana State Police (ISP) Trooper in March appeared in court on Tuesday.
Terry DeWaine Sands II is accused of striking and killing ISP Master Trooper James Bailey on March 3 along I-69, just south of Auburn.
According to court reports, Master Trooper Bailey came in to work on his day off to aid with crashes on I-69 when he heard about a police pursuit with Sands. As Bailey was trying to stop Sands, investigative reports indicate Sands drove into the median and directly into Bailey’s path, striking him with his vehicle.
During a pretrial hearing on Tuesday, the judge granted a continuance for his jury trial, which was originally set for August.
Attorneys requested the continuance after saying they received new evidence in the case. The jury trial is now set to take place in March 2024.
Attorneys also discussed a change of venue during the hearing, although an official motion has not yet been filed.
Sands is charged with murder, resisting law enforcement - use of a motor vehicle causing death, causing death when operating a motor vehicle with a controlled substance, and knowingly/forcibly resisting law enforcement.
